Welcome to First Baptist Church Everett (hereinafter referred to as the "Platform" or "We"). This document establishes the terms and conditions ("Terms of Use") governing the access and use of our social networking platform, as well as all related content, services, features, and applications we offer.
BY ACCESSING OR USING THE PLATFORM, YOU DECLARE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS OF USE AND OUR PRIVACY POLICY. If you do not agree with any provision of these Terms, you must not use the Platform.
1.1. User: Any individual who accesses or uses the Platform, whether registered or not.
1.2. Content: Any information, data, text, software, music, sound, photography, graphics, video, messages, or other materials generated, published, transmitted, or shared by Users or by the Platform.
1.3. Legal Capacity: The User declares they are legally capable of agreeing to these Terms of Use. If under the age of 18 (eighteen), the User declares they have the authorization of a parent or legal guardian.
2.1. Account Creation: To use most features of the Platform, the User must create an account by providing accurate, complete, and up-to-date information.
2.2. Account Responsibility: The User is solely responsible for maintaining the confidentiality of their password and for all activities that occur under their account. First Baptist Church Everett is not responsible for any damage or loss resulting from unauthorized access to the User's account.
2.3. Personal Use: The User account is strictly personal and must not be used by third parties unless expressly authorized by Us.
3.1. Proper Conduct: The User agrees to use the Platform responsibly, ethically, and in strict compliance with applicable laws.
3.2. Prohibitions: The User is strictly prohibited from publishing, transmitting, or sharing any Content that:
Is illegal, defamatory, libelous, injurious, abusive, threatening, obscene, vulgar, pornographic, racist, discriminatory, or incites violence or hatred.
Violates intellectual property rights (copyrights, trademarks, patents) of third parties or the Platform.
Discloses personal information of third parties without proper authorization.
Constitutes spam, chain letters, pyramid schemes, or any form of unauthorized or unsolicited solicitation.
Contains viruses, malware, or any malicious code intended to damage, interfere with, intercept, or expropriate any system, data, or personal information.
3.3. Moderation: First Baptist Church Everett reserves the right, at its sole discretion and at any time, to monitor, edit, or remove any Content that violates these Terms of Use without prior notice.
4.1. User Content: The User holds all rights to the Content they publish on the Platform. By publishing, the User grants First Baptist Church Everett a global, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works, display, and perform such Content in connection with the operation of the Platform and the business of First Baptist Church Everett.
4.2. Platform Property: All design, texts, graphics, interfaces, software, and other elements of the Platform, except for User Content, are the exclusive property of First Baptist Church Everett and are protected by intellectual property laws.
5.1. Privacy Policy: Use of the Platform is subject to our Privacy Policy, which details how we collect, use, share, and protect your personal data. By accepting these Terms, the User also agrees to the Privacy Policy.
6.1. No Warranties: The Platform is provided "as is" and "as available." First Baptist Church Everett makes no warranties that the Platform will function uninterrupted, error-free, or free of viruses or other harmful components.
6.2. Third-Party Content: First Baptist Church Everett does not endorse, warrant, or assume responsibility for the accuracy, usefulness, or legality of any Content published by Users or links to third-party websites. The User is solely responsible for their interactions with other Users.
6.3. Limitation: In no event shall First Baptist Church Everett be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use the Platform.
7.1. By the User: The User may terminate their account at any time by following the procedures on the Platform.
7.2. By the Platform: First Baptist Church Everett may suspend or terminate a User's account, in whole or in part, at any time and for any reason, especially in the event of a violation of these Terms of Use or illegal activities.
8.1. Modifications: First Baptist Church Everett reserves the right to modify these Terms of Use at any time. The most recent version will always be available on the Platform, and continued use after modification implies acceptance of the new terms.
8.2. Governing Law and Jurisdiction: These Terms of Use are governed by the laws of the Commonwealth of Massachusetts. To resolve any disputes arising from these Terms, the parties elect the jurisdiction of the courts in Everett, MA (50 Church St, Everett, MA 02149), waiving any other, however privileged it may be.
